San Francisco Faces Competing Legal Challenges Over Sweeping Family Zoning Package

San Francisco is navigating dual legal battles following the adoption of its Family Zoning framework, an initiative championed by Mayor Daniel Lurie to raise height limits and residential capacity along commercial and transit corridors. The city passed the rezoning ahead of a Jan. 31, 2026, deadline to satisfy state Housing Element obligations requiring capacity for roughly 36,200 additional units.

Opposition to the policy has emerged from two distinct directions. Pro-housing organizations, including YIMBY Law, filed suit arguing the plan does not create sufficient capacity to meet state-mandated targets. Concurrently, groups including Neighborhoods United SF challenged the initiative under the California Environmental Quality Act, asserting the city improperly relied on an addendum to an earlier environmental review rather than conducting a full assessment.

Despite the litigation, developers are already leveraging the updated zoning baseline. In West Portal, DM Development revised a proposal into a 12-story, 172-unit project by combining Family Zoning allowances with Assembly Bill 1287 density bonuses and Senate Bill 423 ministerial streamlining. Other early submittals are advancing in Lone Mountain, Presidio Heights, and Cow Hollow.

For builders and investors, the ordinance currently remains active, offering expanded site yields and streamlining options while the legal challenges proceed through the courts.
