SpaceXAI Faces Up to $6.1M in Mississippi Penalties Over Unpermitted Data Center Work
SpaceXAI's subsidiary MZX Tech LLC has received a notice from the Mississippi Department of Environmental Quality alleging that disturbing construction activity began at sites before coverage under the state's Large Construction Stormwater General Permit was in place. The regulator is seeking civil penalties of up to $25,000 per day, with preliminary exposure of roughly $6.1 million across three sites. The company disclosed the notice in an SEC filing and says it is cooperating and negotiating a resolution.
The three sites are data centers in the Memphis cluster that sit just across the state line in Mississippi. Two are operating and one is still under construction. Separately, the NAACP's Clean Air Act lawsuit over a gas-fired power plant in Southaven can proceed after a federal judge rejected a Justice Department effort to dismiss it. The government had argued that the requested penalties and turbine shutdown could affect national security and economic interests.
SpaceX reported third-quarter revenue of $14.58 billion, with AI revenue at $7.6 billion, and capital spending of $19.6 billion, of which $16.4 billion went to SpaceXAI.
For developers, the practical takeaway is that stormwater permit coverage must be confirmed before any disturbing site work begins, particularly on multi-site campuses that straddle state lines.
