
Palo Alto’s Strategy to Delay SB 79 Compliance Triggers Influx of Housing Proposals
Palo Alto city council members sought to mitigate the impact of California's Senate Bill 79, a state law effective July 1, 2026, requiring higher housing density near public transit. Their plan involved opening a two-week window, hoping to delay full compliance until 2032 by passing an urgency ordinance to temporarily halve permitted heights and densities. This strategy aimed to slow the influx of new development.
Contrary to the city's expectation, the two-week period from July 1 to July 15 resulted in nine applications for multifamily projects, totaling 341 housing units across approximately 395,310 square feet. These proposals are predominantly located near downtown and California Avenue Caltrain stations. Pro-housing groups like Palo Alto Forward supported the window, viewing the resulting incremental growth as beneficial, especially since most proposals are within existing multifamily zones.
This situation highlights a broader trend where California cities navigate state zoning laws that pre-empt local authority, often leading to legal disputes. The city's attempt to declare an emergency to close the gap between SB 79's effective date and their ordinance faced legal challenges from groups like YIMBY Law, who argued against the dubious legal grounds for such a declaration. For developers and property financiers, this demonstrates the ongoing tension between local control and state mandates, and how strategic timing can open opportunities for new projects despite municipal resistance.
