Antheus Capital Faces Investor Lawsuit Over Chicago Multifamily Property

Lake Meadows Holdings LLC, an affiliate of Antheus Capital, is facing a lawsuit from The Straus Group, an investor in the 1,869-unit Lake Meadows apartment complex in Chicago's Bronzeville. Antheus acquired the property at 3233 S. King Drive for $161M in 2023. The Straus Group, which invested $30.5M, alleges that Antheus breached a put option agreement. This option allowed Straus' affiliates to compel Antheus to purchase their interests or market the property for sale if the renovation business plan changed.

The lawsuit, filed in Cook County Court on October 6, claims that Antheus co-founder Eli Unger had presented two distinct business plans to investors: one involving in-place renovations and another requiring the relocation of residents for significant improvements. Straus' affiliates contend that the plan to empty buildings is no longer being pursued, thereby triggering their put option. Antheus, however, argues that the conditions for exercising the option—either the 10-year anniversary of the contract or the completion of renovations—have not been met, as renovations are still ongoing without resident relocation. Antheus has reportedly spent approximately $10M on upgrades to date. The Straus Group is seeking a property valuation and damages equivalent to the fair-market value of their investment, which they estimate at $70M as of June. This dispute underscores the critical importance of clearly defined investment agreements and adherence to stated business plans in large-scale real estate ventures.
